REGATTA BEACH CLUB, A CONDOMINIUM TENANT RULES AND REGULATIONS
1. The leasing or rental of a unit by an owner, either directly or through an agent, is permitted so long as the minimum lease period is not less than ninety (90) consecutive days and no more frequent than three (3) times per calendar year. All written lease agreements must be provided to the association office no later than seven (7) days in advance of the unit occupancy. Any occupancy where the occupant is paying anything for the use of the unit is considered a rental occupancy and is subject to these rules.
2. A unit may not be leased or rented if the owner is delinquent to the association by more than 15 days in connection with the payment of their maintenance and/or ISTA fees unless written arrangements have been made with the association for payment of rent which will be applied toward the delinquent balance. Delinquencies of more than 90 days, by Statute, trigger additional sanctions, which will be communicated directly to those owners by mail.
3. An association adopted LeaseAddendum Agreement, signed by both the owner and tenant is required by the association. For all lease occupancies and must be received by the association no later than seven (7) days prior to the time the tenant(s) arrive, if not sooner. Upon arrival, lessees are required to present themselves at the front desk for administrative processing for accessand identification.
4. Tenants have full use of the facilities provided they comply with the rules governing their use. Owners who lease their units give up their use rights of the association facilities in favor of their tenant(s) for the duration of the lease, and the unit owner shall have no right to use of the association facilities, unless asan accompanied guest of another unit owner.
5. Owners are responsible for the actions of their tenants and/or guests and any damage to the common property as a result of any tenant and/or guest will be the responsibility of the owner, in addition to any responsibility the tenant and/or guest may have in connection to the damage sustained.
6. All unit tenants and their guests are subject to a" rules in effect. A tenant signed copy of the rules must be received by the association office upon arrival.
7. Guests, in the absence of the tenant(s) are not permitted. All over-night guests must register with the association office upon arrival. All guests shall be registered at the front desk by the tenants. Guests shall register their car and display a parking pass on the dashboard. If the tenant wishes, a temporary fob may be issued to the tenant for overnight guests for an upfront refundable charge of $25.00. Should the fob not be returned in working order when the guest departs, the tenant will forfeit the $25.00 fee.
8. Sub-letting of residential units by tenants is not permitted. No tenant may loan a unit for unaccompanied occupancies as the residence of a leased unit shall only be occupied by persons indicated on the paperwork on file with the association.
9. Commercial Unit rentals are not subject to approval, and are not subject to he minimum rental term or LeaseAddendum requirement. However, ommercial unit owners are prevented from using the association facilities if heir unit(s) has been rented, are subject to the provisions which state that enants and guests are subject to all rules and regulations and are liable for damage to common property if caused by their tenant(s) or guests.
